How Colorado Law Defines Criminal Impersonation

Criminal impersonation is defined under Colorado’s criminal code as conduct where a person commits criminal impersonation by assuming a false or fictitious identity or capacity and performing certain acts with intent to unlawfully gain a benefit or to injure or defraud another.

Colorado criminal impersonation focuses on conduct, not just false statements. The offense is committed when a person:

  • Assumes a false or fictitious identity
  • Assumes another person’s identity or legal capacity
  • Uses fictitious personal identifying information
  • Performs an act that creates legal consequences for another person

False or Fictitious Identity Explained

false or fictitious identity may involve using a completely made-up identity or unlawfully using the identity of a real person. This includes using:

  • A fictitious identity or capacity
  • False or fictitious personal identifying information
  • Such identity to interact with courts, officers, or third parties

The person falsely impersonated may be exposed to criminal or civil liability, even though they had no involvement in the conduct.

Acts That Constitute Criminal Impersonation

Colorado law specifies several acts that, when done under a false identity, can result in criminal impersonation charges.

These include situations where a person:

  • Becomes bail or surety for a party
  • Appears in a court or before an officer authorized to take testimony
  • Initiates or defends an action or special proceeding, civil or criminal
  • Executes, subscribes, verifies, publishes, acknowledges, or proves a written instrument
  • Performs an act that, if done by the person falsely impersonated, might subject such person to criminal or civil liability

Each act must be done with intent to unlawfully gain a benefit or to injure or defraud another.

Criminal Impersonation in Violation of Subsection (1)

Many charges allege criminal impersonation in violation of subsection (1) of the statute. This typically refers to situations where the defendant assumes an identity and performs an act that directly creates legal exposure for another person.

Prosecutors often focus on whether the conduct involved:

  • A false impersonation
  • A fictitious identity or legal capacity
  • A proceeding civil or criminal
  • A special proceeding

Marriage and Legal Relationship Allegations

Some criminal impersonation cases involve allegations related to marriage relation or marriage relation toward another.

Examples include:

  • Falsely claiming to be legally married
  • Acting to sustain the marriage relation under false pretenses
  • Representing oneself as another person to marry or to sustain a legal relationship

These cases are rare but taken seriously due to the legal consequences involved.

Role of Police Officers and Authorized Officials

Criminal impersonation frequently involves interactions with a police officerpeace officer, or other officer authorized to perform legal functions.

Examples include:

  • Giving a false identity during a traffic stop
  • Appearing before a court or officer authorized to take acknowledgments
  • Providing false information in an official proceeding

Impersonation before a court or officer is a significant aggravating factor.

Criminal Charges and Classification

Under Colorado law, criminal impersonation is commonly charged as a class 6 felony, although the exact classification depends on the alleged conduct.

A section of the statute specifies that this section is a class felony when the impersonation involves certain acts or legal consequences.

Potential penalties include:

  • Jail time or prison time
  • Mandatory parole
  • Fines and court costs
  • A permanent criminal record if found guilty

Criminal Impersonation vs Identity Theft

Although related, criminal impersonation is distinct from identity theft. Criminal impersonation focuses on assuming identity or legal capacity to perform an act, while identity theft typically focuses on financial gain.

However, the same conduct may result in multiple criminal charges under the Colorado criminal code.

What the Prosecution Must Prove

To secure a conviction, the prosecution must prove each element beyond a reasonable doubt, including:

  • The defendant assumed a false or fictitious identity
  • The defendant performed a qualifying act
  • The act was done with intent to unlawfully gain a benefit or injure or defraud another
  • The conduct exposed the person falsely impersonated to liability, charge, forfeiture, or penalty

Failure to prove any element can result in dismissal or acquittal.

Common Defenses to Criminal Impersonation Charges

An experienced criminal defense attorney may raise defenses such as:

  • Lack of intent to unlawfully gain
  • Mistaken identity
  • No qualifying act performed
  • No actual or potential legal liability created
  • Reasonable doubt regarding intent or identity

Each case depends heavily on the facts and surrounding circumstances.

Serious Consequences of a Conviction

A criminal impersonation conviction can lead to severe penalties and long-term consequences, including:

  • Prison time
  • Mandatory parole
  • Difficulty securing employment or housing
  • Loss of professional licenses

Because these charges are felonies, early legal intervention is critical.

Why Experienced Legal Representation Matters

Criminal impersonation cases often involve dense statutory language, legal references, and procedural issues involving courts, officers, and special proceedings.

An experienced criminal defense attorney understands how to analyze the statute, identify weaknesses in the prosecution’s case, and protect the rights of the accused throughout the process.

A Light in the Darkness

Most people live their lives never dreaming they would ever need the services of a criminal defense attorney. But, sometimes, life takes a hard left turn with no warning and you can find yourself in a very dark and scary place. When that happened to us we didn’t know where to turn. But, our daughter did. An old classmate and friend, Jeffrey Wolf, was the person to call. So we did. We called an attorney but a hero was who showed up. Mr Wolf is a picture of competence with compassion. He alleviated many of our fears and answered every question with confidence. During this most difficult time he made it possible for us to continue to live our lives and actually sleep at night knowing that we were in the best possible hands. Our family will be forever grateful to Mr Wolf as he truly is a Light in the Darkness.

Best possible outcome!

I was facing felony assault charges for an altercation I got into and needed an attorney. It was self defense but the DA was not seeing it that way. After calling around I found Wolf law and spoke with Colleen Kelley on the phone about my case. From the get go she was very professional and I could tell that she truly cares for her clients and their rights and wants to get the best possible outcome. So many attorneys out there just go through the motions and take peoples money. Colleen is not one of them! She knows the law and knows your rights. She’s very experienced in these types of cases and it showed! We took this case all the way to trial and Colleen was nothing short of exceptional in court! She left no stone unturned and was 110% prepared when my trial date came around. She also did an exceptional job preparing me for trial. I felt very confident going into trial because Colleen was in my corner. Communication was great throughout the whole process. Needless to say we got the result we were looking for and I was found not guilty on all counts. I will forever be grateful to Colleen for her services and I am thankful that I chose her to represent me. If you’re looking for a top notch attorney, pick up the phone and call Colleen!

I Couldn’t Have Asked for a Better Lawyer

Until the night of my DUI, I had never been in trouble before so one could only imagine how scared I was. Facing a DUI with a possible felony/assault charge, I honestly wasn’t sure how I was going to get through it all. I happened to find Jeffrey Wolf through another lawyer. After meeting with him in person, I knew immediately that he was going to help me. I was a complete wreck from day 1 and yet he made me feel at ease with every meeting, phone call and court appearance.

One of the traits I appreciated most was his honesty. Mr. Wolf told me straight up from the beginning what could happen and what I was facing but reassured me that he would do everything he could to get me through it with the best outcome. Having him there with me through this process and through every court appearance with him by my side made it easier to handle and I am so grateful to have worked with him. At the end of it all, I was able to get probation with a deferred judgment on my case. I would absolutely refer Mr. Wolf to any of my friends and/or family!

I Recommend Jeff Wolf to Anyone Needing Legal Defense

I retained the services of Jeff Wolf after I received a DUI. During the free consultation, Jeff reviewed his services and the details of what would happen before, during and after my trial. He was very thorough, supportive and diligent in ensuring all my questions were answered. I am thrilled with the level of service he provided for an extremely reasonable fee. Jeff was accessible and reassuring throughout this entire process. The end-result of my hearing was exactly what I had expected based on Jeff’s counseling. This is a direct result of his knowledge and experience with the court and the system. I was very impressed with his closing presentation in court and his professionalism and felt that the judge reduced my fines and my sentence because of Jeff’s efforts. I have already recommended him to two other people and will continue to recommend him to anyone requiring the services of a defense attorney.

The best lawyer you could ever hire !!!

Jeffrey Wolf is the best lawyer you could ever hire. He most definitely went way above and beyond the call of duty for me and my case. I’m sure that some of you have hired other lawyers in the past and it seemed like they drug their heels, and wouldn’t return calls, which made you feel that they didn’t care about you.

As far as I’m concerned that will never happen to you if you hire Jeffrey Wolf. He treated me like I was either his best friend or a member of his family, that’s how I felt dealing with him. I honestly looked forward to his calls. He seems like a super cool/good guy. If I lived in Colorado I would be honored to even hang out sometime, maybe shoot some pool, go bowling, ect just have fun. But the most important thing as far as business goes he got an amazing result for me in the case he represented me for. If yall don’t hire Jeffrey as your attorney then you’re making a HUGE mistake that you will probably regret the rest of your life. Again tyvvvvvvvm Jeffrey Wolf for taking care of me. You are the best.

Look No Further – Jeff is the Best

I was falsely accused of a crime with serious consequences, was very depressed and got even more depressed and frustrated as I was interviewing attorneys to defend me. They had a broad spectrum of approaches and some were ready to head to trial immediately as it seemed they were primarily interested in battles and my money rather than my best interests. The first one was extremely arrogant and rushed to get me off the phone. My court appearance date was approaching and I was ready to give up when I came across Jeffrey’s website. I read he had once also been falsely accused which motivated him to become an attorney. After further reading, his philosophy appealed to me so I set up a free session.

I met with Jeffrey and told him what happened. He explained the alleged crime and potential consequences and then spoke about himself and his approach. I spent more time than the “free time” allocated but was never rushed. He listened, believed me and was really genuine as I had not witnessed before with other attorneys.

By the time we finished talking, I felt respected and not disrespected as I found out with this accusation, you are guilty until proven innocent from most everyone’s perspective. I hired Jeff on the spot and when I left his office, I felt this big burden lifted off my shoulders as I knew I could trust him to do his best for me. I was finally able to sleep that night and after several weeks able to put this out of my mind as being the constant main focus.

If you are seeking a very knowledgeable, trustworthy, caring, honest and respectful attorney, Jeffrey fits the bill. He is a great listener and never rushed me even with a flat fee rate. He has a good rapport with the Court who also respectfully listens to him. He is well spoken in the courtroom. I have seen him in several cases reaching very good settlements for his clients. On my case, he provided me his opinion with his rationale as to how I should proceed but allowed me to then make a decision as to go to trial or take a plea bargain. He would fully support my decision either way. Jeff is very good in providing the pros and cons, risks, and potential scenarios that may play out. My case will be dismissed shortly and record sealed as a result of Jeff’s hard work, negotiations, poking holes in the accuser’s story pre-trial, and dedication to my satisfactory case resolution. If you want the best, look no further as you have found him. Thank you Jeff!
